For most operators of affected smaller facilities, the lawsuit settlement SettlementAgreement.pdf will not appreciably change the deadline or requirements for compliance with the SPCC rule.   The EPA has not indicated in what fashion it will commence with enforcement, but operators are urged to consider their potential exposure to drive-by observation, detectable environmental release and consequential fines or environmental cleanups, when evaluating the relatively modest cost of compliance.  For a plain language primer on the basics of SPCC Plans please click (link to Frequently Asked Questions)
